OPINION

GEMMILL, Judge.

¶ 1 Albert C. Kuck appeals his conviction and sentence for one count of second degree murder, a class one dangerous felony. In this Opinion, we address Kuck's contention that the trial court improperly denied him a twelve-person jury.1 For the following reasons, we affirm his conviction.
