This is an action brought by plaintiff Gregory Panko ("Panko")for breach of contract and for a violation of 15 U.S.C.A. § 1681m (2005), a provision of the Fair Credit Reporting Act ("FCRA"), against defendants Discover Financial Services LLC ("Discover"), Discover Bank (the "Bank") and Marc Taylor ("Taylor").
