The Government seeks to dismiss a complaint brought by Plaintiff Jose Leonel Baez-Fernandez ("Baez-Fernandez" or "Plaintiff") on the grounds that the Court lacks subject matter jurisdiction and Plaintiff has failed to state a claim upon which relief may be granted.
