John Madden, on behalf of himself and the other passengers injured when a commuter train collided with a semi-tractor trailer, appeals the trial court's grant of summary judgment to the Indiana Department of Transportation ("INDOT"). Madden raises one issue, which we restate as whether INDOT designated sufficient evidence to demonstrate it was entitled to discretionary function immunity.<...
