The defendant, Charles Price, was convicted of two counts of theft (720 ILCS 5/16-1(a)(1), (4) (West 2002)) and sentenced to concurrent five-year terms of imprisonment. On appeal, the defendant argues that (1) his two theft convictions are legally inconsistent; (2) the circuit court erred when it failed to instruct the jury on a lesser offense; and (3) one of the defendant's convictions must be vacated according...
