J.R. v. STATE

No. 5D04-4318.

891 So.2d 642 (2005)

J.R., A Child, Petitioner, v. STATE of Florida, Respondent.

District Court of Appeal of Florida, Fifth District.

January 28, 2005.

Attorney(s) appearing for the Case

Robert Wesley, Public Defender, Christine M. Warren, Assistant Public Defender, Orlando, for Petitioner.

Charles J. Crist, Jr., Attorney General, Tallahassee, and Kellie A. Nielan, Assistant Attorney General, Daytona Beach, for Respondent.

PER CURIAM.

J.R. has filed a petition seeking a belated appeal. The appointed public defender asserts that while preparing the documents to appeal, she was unable to remember the child's name and so did not file an appeal. The Attorney General candidly acknowledges that J.R. is entitled to receive a belated appeal. SeeState v. Trowell, 739 So.2d 77 (Fla.1999). Accordingly, we grant J.R.'s petition for a belated appeal.
