Defendant pleaded guilty to attempted rape in the first degree, stemming from his attack on a 17-year-old girl, and was sentenced as a second felony offender to a prison term of six years. Prior to his release, the Board of Examiners of Sex Offenders evaluated and presumptively classified defendant as a risk level III sex offender pursuant to the Sex Offender Registration Act (see Correction Law art 6-C).
