This matter came before the court on the parties' cross motions for summary judgment. By Order entered March 31, 2004, the court granted in part and denied in part plaintiffs' motion for summary judgment. The court also granted in part and denied in part defendants' motion for summary judgment. The reasons for those rulings follow.
