The plaintiff, Emory Johnson, Jr., filed suit on October 20, 2003 against his former employer, Aluminum Company of America ("ALCOA"), under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq., and 42 U.S.C. § 1981.
