This employment discrimination action is presently before the Court on motion of the defendant for summary judgment. For the reasons which follow, the motion shall be granted as to the plaintiffs federal law claims and this case dismissed with leave to Plaintiff to re-file his remaining state law claim in the appropriate state court.
