I. INTRODUCTION
On February 18, 2003, Gary Berne brought this action to enforce a settlement agreement and recover damages from Louis Boschulte, Marjorie Lewis, and Dilsa Capdeville. These parties signed the settlement agreement in question on July 6, 1998 to resolve an action before the Territorial Court of the Virgin Islands captioned Gary Berne v. Louis Boschulte et al., Civ.
