OPINION AND ORDER

On January 26, 2004, plaintiff Thomas Rivera Schatz ("Rivera Schatz") brought this action under 42 U.S.C. § 1983 against the defendants1 for alleged violations of his rights under the First, Fifth and Fourteenth Amendments to the United States Constitution. Rivera Schatz seeks declaratory and injunctive relief -the invalidation of Puerto Rico's riot act2
