I. INTRODUCTION

Before me is a Motion for Summary Judgment (Docket Item ["D.I."] 116; the "Motion") filed by defendants E.I. du Pont de Nemours & Co. Inc., a Delaware corporation, and the Board of Benefits and Pensions of E.I. du Pont de Nemours & Co. Inc. ("the Board") (collectively "DuPont").
