On March 12, 2001, Thomas Ronald Theodore ("Theodore") was convicted of nine counts of mail fraud and three counts of violating the Food, Drug, and Cosmetic Act.1 He was sentenced to 121 months in prison.2 Theodore appealed his conviction, alleging several errors by the district court.
