This action is before the Court on Defendants' motion for summary judgment [Record No. 25]. Plaintiff has responded [Record No. 34], and Defendants have replied [Record No. 35]. The Court notes that Plaintiff has requested oral argument on this motion [Record No. 34]. The Court does not believe that it is necessary and the request shall be denied.
