I. INTRODUCTION

The Judicial Conduct Board ("Board") filed a Complaint with this Court on February 25, 2004 against Judge Mark Peter Pazuhanich ("Respondent"). The Complaint contains two Counts which charge Respondent with a violation of Article V, § 17(b) of the Pennsylvania Constitution (Count 1) and with a violation of Canon 2(A) of the Code of Judicial Conduct (Count 2).
