This matter comes before the Court on the General Services Administration's ("GSA") Motion to Dismiss, Doc. 26, pursuant to FED R. Crv. P. 12(b)(6). During a hearing conducted on October 29, 2004, the Court DENIED GSA's Motion to Dismiss. This Order explains the rationale for the ruling on the motion.
