ORDER

GOTTSCHALL, District Judge.

The Court adopts Magistrate Judge Levin's January 16, 2004 Report and Recommendation as the order of the court. Defendant's motion for summary judgment is denied. Plaintiff's motion for summary judgment is granted insofar as it requests a remand. This cause is remanded to the Commissioner for further proceedings consistent with the attached opinion.
