This matter is before the Court on the motion of Plaintiff Kalamazoo Acquisitions, L.L.C. ("Kalamazoo"), and on the motion of Defendant Westfield Insurance Company, Inc. ("Westfield"), for summary judgment. The motions have now been fully briefed and oral argument is unnecessary in light of the extensive briefing and the questions presented.
