Defendant the New York Botanical Garden (the "Garden") has moved pursuant to Rule 56 of the Federal Rules of Civil Procedure and Local Rule 56.1 to dismiss the complaint of plaintiff Paul Evans ("Evans"), who alleges that he was fired as a result of racial discrimination and his filing of a complaint with the New York State Division of Human Rights.
