Justice FITZGERALD delivered the opinion of the court:

Following a bench trial in the circuit court of Cook County, defendant Bernard Bunch was convicted of possession of a controlled substance and sentenced to a four-year term of imprisonment. The appellate court determined that the trial court erred in denying defendant's motion to quash arrest and suppress evidence and reversed defendant's conviction. 327 Ill.App.3d 979
