Presently before the Court are cross motions for summary judgment. Defendants have filed a motion for summary judgment on all counts (Doc. No. 97), and Plaintiffs have filed a motion for partial summary judgment on Count I (Doc. No. 110). For reasons stated more fully below, both Plaintiffs' motion and Defendants' motion are DENIED.
