OPINION

REBECCA BEACH SMITH, District Judge.

This action is before the court on plaintiff's and defendants' cross-motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the reasons stated below, defendants' motion for summary judgment is GRANTED and plaintiff's motion for summary judgment is DENIED.
