LAVERY, C. J.

This appeal concerns whether a petition for a new trial can be filed pursuant to General Statutes § 52-2701 where there is no final judgment in the underlying action. We conclude that a final judgment is a condition precedent to the proper filing of a petition for a new trial. We therefore affirm the judgment of the trial court dismissing the petition for a new trial, albeit on different grounds...
