This appeal arises out of an action brought in the district court arising from a collision on February 19, 1991, in Conway, New Hampshire, between a 1986 Volkswagen Vanagon and a 1979 AMC Concorde. The Vanagon was driven by David Trull. His two sons Benjamin and Nathaniel were seated in the rear passenger seat. Benjamin was killed; his brother, Nathaniel, received serious injuries.
