OPINION AND ORDER

SARGUS, District Judge.

This matter is before the Court on the Order of Remand of the United States Court of Appeals for the Sixth Circuit. (Doc. # 83). The issue before the Court is Defendants' Motion to Dismiss Counts I, III, and IV. (Doc. # 19). For the reasons set forth below, the Court concludes that Defendants' Motion to Dismiss is DENIED IN PART and GRANTED IN PART.
