HART, District Judge.

In 1994, following a jury trial in the Circuit Court of Cook County, Illinois, Timothy Tate was found guilty of first degree murder. The murder occurred in July 1991, when Tate was 15 years old. Stanley Sellers, who had been with Tate and two others at the time of the murder, testified that Tate was the one who shot the victim.
