Plaintiff, Daniel Wineholt ("Wineholt"), has sued Defendant, Cincinnati Insurance Company ("CIC"), alleging that CIC breached the terms of an insurance policy by failing to pay Wineholt for a loss covered by the policy. Wineholt initially filed this case in Kent County Circuit Court. On January 29, 2001, CIC removed the case to this Court on the basis of diversity jurisdiction.
