THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. DAMON FOY, Appellant.

Appellate Division of the Supreme Court of the State of New York, Second Department.

Decided April 16, 2001.

Ordered that the judgment is affirmed.

Contrary to the defendant's contention, the trial court's charge regarding his alleged oral statement was proper, and the court correctly refused to provide an additional charge on the issue (see, People v Sharlow, 185 A.D.2d 289).

The sentence imposed was not excessive (see, People v Suitte, 90 A.D.2d 80).
