On October 10, 2000, Plaintiff filed suit against Defendants, alleging that the negligent operation of a backhoe caused him personal injuries on October 1, 1998. In August of 2001, the parties agreed to settle the case for $50,000, and Plaintiff signed a release on September 7, 2001.
