When this case was previously before us, we reversed defendant's conviction for sexual abuse in the first degree* and remitted the matter for a new trial (267 A.D.2d 501, lv denied 94 N.Y.2d 950). Following the retrial, defendant was convicted of the lesser included offense of sexual abuse in the third degree.
