The one count indictment in this case charges defendant Gaki Antonio Rodriguez-Diaz with possession with intent to distribute more than 100 grams of heroin, in violation of 21 U.S.C. § 841(a)(1). The case arises from the seizure by a Baltimore County police officer of a quantity of heroin in consequence of a traffic stop of a motor vehicle being operated by Rodriguez-Diaz and a subsequent search of the vehicle.
