The verdict was based on legally sufficient evidence and was not against the weight of the evidence. Defendant's intent to kill the victim who escaped injury could be reasonably inferred from the totality of defendant's conduct, particularly with respect to the seriously wounded victim, as well as the surrounding circumstances (see, People v Cabey, 85 N.Y.2d 417, 422).
