Jose Garcia was sentenced to a term of imprisonment of forty months for violation of 18 U.S.C. § 841(a). At the sentencing, the court denied Garcia's request for a downward departure pursuant to section 5K2.0 of the Sentencing Guidelines. Garcia has appealed this ruling of the court.
