John Henry Stitt ("defendant") was charged and convicted of one count of felony possession of a Schedule II controlled substance (cocaine), one count of resisting a public officer, and one count of being an habitual felon. Defendant received a prison sentence of 144 to 182 months for the two felony charges, and a sentence of sixty days for the misdemeanor offense of resisting a public officer.
