A plaintiff seeking damages and injunctive relief under the Americans with Disabilities Act by virtue of a mental illness faces a treacherous road to recovery. If he submits insufficient proof of the symptoms of his illness, a trier of fact might well conclude that he is not "disabled," and is, therefore, outside the protective scope of the Act.
