This action arises out of a two-car collision between vehicles driven by defendant Susan J. Downes (hereinafter defendant) and Erma V. Timmerman (hereinafter decedent). The accident occurred on December 4, 1995 on Gee Hill Road, a 55 mile-per-hour, two-lane highway in the Town of Virgil, Cortland County.
