In separate misbehavior reports, petitioner and his cellmate were charged with violating the prison disciplinary rule which prohibits inmates from starting a fire. On the same day, the same Hearing Officer conducted separate tier III disciplinary hearings on the misbehavior reports and, after petitioner's hearing, he was found guilty of the charge.
