For a second time now this Court has granted certiorari in this matter. In our first grant of certiorari, we considered only one of the two divisions in a Court of Appeals' opinion, and we reversed. On remand, the Court of Appeals held that because our opinion did not contain express language limiting our reversal to only the one division considered, it was "constrained" to vacate both divisions of its earlier opinion.
