A jury found by a preponderance of the evidence that a defectively designed product of defendant Innovasive Devices, Inc. ("Innovasive") was a substantial factor in causing harm suffered by plaintiff, Scott Zemaitatis. The verdict awarded Zemaitatis was $47,000 in medical expenses and $250,000 for pain and suffering.
