In January 1993, Pedro Jumping Eagle was arrested for sexually assaulting a nine-year-old female. Jumping Eagle was charged with first-degree criminal sexual conduct, in violation of Minn.Stat. § 609.342, subd. 1(a) (1992), and subsequently pleaded guilty to the charged offense, pursuant to a plea agreement that made a number of contingent recommendations to the court regarding sentencing.
