On 12 May 1997 defendant was indicted for one count of attempted murder. Defendant was tried before a jury at the 23 March 1998 Criminal Session of Superior Court, Alamance County. At the conclusion of all the evidence, the trial court, over defendant's objection, instructed the jury on two degrees of attempted murder—"attempted first-degree murder" and "attempted second-degree murder."
