This case is before the Court on Defendant's Motion to Dismiss or in the Alternative for Summary Judgment pursuant to Rules 12(b)(6) and 56 of the Federal Rules of Civil Procedure [Document # 7]. Also before the Court is Defendant's Motion to Strike Jury Demand as to Plaintiff's Rehabilitation Act Claim [Document # 9].
