This action arises as the result of an automobile accident. This matter is presently before the court upon defendant's motion to dismiss.

On January 29, 1997, a collision occurred on the military reservation at Fort Riley, Kansas involving vehicles driven by plaintiff, Pauline I. Perry, and Michael Sternberg. Both plaintiff and Sternberg were active members of the United States Army at the time...
