These two actions are citizen suits brought pursuant to section 505(a) of the Clean Water Act ("CWA"), 33 U.S.C. § 1365(a). Plaintiffs claim that the Cities of St. Paul and Minneapolis are discharging storm water into the Mississippi River, in violation of the CWA's permit requirement for storm water runoff.
