This matter is before the Court on "Defendant Michelin North America, Inc.'s Motion to Dismiss, or, Alternatively, to Compel Arbitration" filed August 20, 1999. Plaintiffs responded to that motion on September 22, 1999 to which defendant replied on October 12, 1999. For the following reasons, the motion to dismiss will be denied.
