MEMORANDUM OF DECISION AND ORDER

This matter is before the Court on a motion for summary judgment filed by the defendants on June 1, 1999. Plaintiff responded to that motion on July 26, 1999 to which defendants filed a reply on August 10, 1999.1 For the following reasons, the motion for summary judgment will be denied.
