This matter comes before the Court on a motion for partial summary judgment filed by defendant Orion Sales, Inc. ("Orion"). The Court has decided the matter pursuant to Rule 78 of the Federal Rules of Civil Procedure. For the reasons stated herein. the Court will grant defendant's motion for partial summary judgment.
