I. INTRODUCTION

The Government of the Virgin Islands ["government" or "appellant"] appeals the order of the Territorial Court dismissing the first of three counts2 of an information filed against Albert John ["John" or "appellee"]. For the reasons set forth below, the Court will vacate the order of the Territorial Court.
