BERMAN, District Judge.
The issue at bar is whether Plaintiff Irving A. Gelb's ("Plaintiff" or "Gelb") current case against Defendants, the Board of Elections in the City of New York ("Board") and individual Board members and employees, is sufficiently different, factually and/or legally, from Mr. Gelb's 1994 case ("Gelb I") against essentially the same defendants to warrant a different outcome.
